General information

With the publication of this price list the previous price list loses its validity. The purchase prices in € (EK) are basic prices without VAT and discount. The non-binding recommended retail prices in € (RRP) include 19 % VAT. We reserve the right to make changes. Deviating terms and conditions are only effective if they are confirmed by us in writing. In case of illustration and use of logo, graphical material or text extracts, a written consent from us is required. For the operation of a webshop a partner contract with us is required. This contract regulates, among other things, the use of our logo, image material and text extracts. For this we charge a one-time nominal fee of 50,- € net. The customer undertakes to store goods properly and to offer them for sale (temperatures between 4°C and + 23°C).

As a matter of principle, we do not use standardised raw materials, therefore fragrance, colour and consistency may change slightly. This is not a lack of quality, but rather proof of the consistent use of natural raw materials. When exposed to heat, some oil may settle in the creams. This does not reduce the quality of our cosmetics and can be remedied by stirring. The following applies to all our products: Use within 3 months after opening.

Offers and orders

Our offers are subject to change and non-binding. Orders can be placed in writing, by telephone, fax, e-mail or via our online shop. When placing an order, the buyer acknowledges our delivery and business conditions. The order is considered as accepted when the order is confirmed in writing or when ordered goods are delivered. Deviating AGBs require the written form. In the case of telephone orders, we do not accept liability for misunderstandings and resulting incorrect deliveries. After presentation of a copy of your trade licence you will receive our products at the purchase price. If the net order value is over 250,- €, you will receive a 5% discount. Provided that you have attended a seminar with us last year and take part in a further training every three years, you will receive a discount of 7 % from a net order value of 500,- €.

 

Advertising material

For annual net sales of more than € 1,200, - we grant a 6% refund as a credit for advertising material (sachets, samples, testers, posters, advertisements and carrier bags). This regulation also applies to orders placed via wholesale. For this purpose Martina Gebhardt Naturkosmetik GmbH may obtain the annual sales figures from wholesalers. The credit note for advertising material is only credited for direct orders (minimum order value 100 €). Remaining credit can be used up 2 months after the end of the following year.

 

Refund

Additionally for direct orderers:

Annual net sales of over 4,000 €: 4 % refund. The refunds are issued as a contingent of advertising material and cabin goods and will be credited in case of a direct order.

 

Delivery

The minimum order value is 150,- €. Within Germany we deliver postage free. Outside Germany we charge the postage according to expenditure. First orders will be delivered by us exclusively against prepayment (by bank transfer). The buyer is obliged to accept ordered goods in due time. If we receive notice of a sustained deterioration in the financial circumstances of the buyer, we may make delivery dependent on prior payment or other appropriate security or refuse to deliver.

 

Complaints

In the case of complaints, the cause of which is not attributable to the manufacturer's fault, no return will be accepted. Complaints for which the manufacturer is responsible must be notified to the manufacturer, stating the voucher or invoice number, no later than the next working day after delivery. Please note: Pure natural cosmetics can often show variations in fragrance, colour and consistency, such complaints do not lead to a return.

 

Damage in Transit

Shipments damaged in transit are to be claimed immediately to the deliverer and acceptance is to be refused. Damage that is only recognized after acceptance of the shipment (hidden damage) must be reported to the carrier (post office, parcel service, forwarding agent, etc.) within 48 hours. In this case, the goods must be returned to our company, carriage paid, together with a written declaration.

 

Payment

Payments are made by SEPA direct debit. The buyer authorises us to collect all amounts due from his bank account. Prepayment applies to first orders. If the direct debit is not honoured, a flat rate of 20,- € will be charged. In case of default of payment, interest on arrears of 5% will be charged.

 

Liability

Martina Gebhardt Naturkosmetik GmbH is only liable for its own conduct as well as that of its employees or vicarious agents in the case of grossly negligent or intentional conduct. The claim in case of liability is limited to the rate of the proven, direct damage. The goods remain our property until full payment has been made. Place of performance and jurisdiction is Weilheim. Should a provision in the terms and conditions be invalid, the validity of all other provisions shall not be affected, but shall be replaced by a provision which comes closest to the intended contractual objective in economic terms. We reserve the right to change the terms of delivery and payment. Please ask separately for new listings.
