General terms of delivery for retailers, cosmeticians, spas and wellness hotels

MG Naturkosmetik GmbH processes the orders. The terms and conditions of MG Naturkosmetik GmbH apply.

General

When this price list is published, the previous price list and the terms of delivery and business cease to apply. Purchase prices in € (EK) are base prices excluding VAT and discounts. Recommended retail prices in € (UVP) include 19% VAT. We reserve the right to make changes. Deviating terms are valid only if we confirm them in writing. Use of our logo, images or text extracts requires our written consent. Operating an online shop requires a partner agreement with us. Among other things, that agreement covers use of our logo, images and text extracts. For this we charge a one-time protection fee of €50.00 net. The customer undertakes to store goods properly and offer them for sale (temperatures between 4°C and +23°C).

We do not use standardised raw materials as a matter of principle, so scent, colour and consistency may vary slightly. This is not a quality defect, but evidence of consistent use of untreated natural raw materials. Heat may cause a little oil to separate on the creams. This does not reduce the quality of our cosmetics and can be remedied by stirring. For all our products: use within 3 months of opening where possible. Deviating terms of delivery and business must be in writing.

Offers and orders

Our offers are subject to change and non-binding. Orders may be placed in writing, by telephone, by email or via our online shop. By placing an order, the buyer accepts our terms of delivery and business. The order is accepted when it has been confirmed in writing or the goods have been dispatched. For telephone orders we accept no liability for misunderstandings or resulting incorrect deliveries. After you send a copy of your business registration, you receive our products at purchase price. If the net order value is over €250.00, you receive 5% off.

Promotional materials

On request, and after review, we provide promotional materials free of charge in a reasonable quantity. This also applies to orders placed through wholesalers. For this purpose MG Naturkosmetik GmbH may obtain annual sales figures from wholesalers.

Delivery

The buyer undertakes to accept ordered goods on time. If we learn of a lasting deterioration in the buyer’s financial circumstances, we may make delivery dependent on advance payment or other appropriate security, or we may refuse delivery. The minimum order value is €100 net plus a small-order surcharge of €7.50. From a net order value of €200 we deliver free of shipping charges.

Complaints

Where a complaint is not the manufacturer’s fault, goods are generally not taken back. Complaints for which the manufacturer is responsible must be reported to the manufacturer, quoting the delivery note or invoice number, no later than the next working day after delivery. Please note: pure natural cosmetics can vary in scent, colour and consistency; such complaints do not lead to a return.

Transport damage

Shipments damaged in transit must be reported to the carrier immediately, and acceptance must be refused. Damage discovered only after acceptance (hidden damage) must be reported to the carrier (postal service, parcel service, freight forwarder, etc.) within 48 hours. In that case the goods must be returned to us carriage paid, together with a written statement.

Payment

First orders are delivered against advance payment only. From the second order onwards, a switch to direct debit is possible. The buyer authorises us to collect all amounts due from their bank account. If a direct debit is not honoured, a flat fee of €20.00 is charged. In the event of late payment, default interest of 5% is charged.

Liability

MG Naturkosmetik GmbH is liable for its own conduct and for that of its employees or vicarious agents only in cases of gross negligence or wilful misconduct. Any claim is limited to proven, direct damage. Goods remain our property until paid in full. Place of performance and jurisdiction is Weilheim. If a provision of these terms of delivery and business is invalid, the remaining provisions stay in effect and shall be replaced by a rule that comes closest economically to the intended purpose. We reserve the right to change these terms. Please enquire separately about new listings.
